These terms apply to the LAPSE iOS app and this website. By using the app you agree to them. If you do not, please do not use it.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use LAPSE on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell or redistribute the app.
2. What LAPSE is for
LAPSE is a camera and record-keeping app. It helps you photograph the same subject the same way over time, and shows you the difference.
It is not a medical device, and nothing it shows you is a diagnosis, a measurement of your health, or medical, dental, dermatological, nutritional or fitness advice. If you are tracking something about your body, your pregnancy, your skin, your hair or a recovery, talk to a qualified professional. Do not use a photograph in this app to decide anything clinical.
3. Your photographs are yours
You own everything you photograph in LAPSE. We claim no licence over it, no right to use it, and no right to look at it. We could not exercise such a right if we wanted to: your photographs never leave your device, as described in the Privacy Policy.
Because they live only on your iPhone, they are yours to look after. Deleting the app, deleting a journey, or losing or resetting the device removes them, and we have no copy to restore. If they matter to you, back up your iPhone — LAPSE photographs are included in an iPhone backup.
Photograph only what you have the right to photograph. If a journey includes another person — a child, a partner, a client — that is your responsibility, including their consent.
4. Reminders
LAPSE can send you a reminder when a check-in is due. Notifications are delivered by iOS and are best-effort, not guaranteed: Focus modes, Low Power Mode, notification settings, a restarted phone or the operating system itself can delay or suppress one.
Missing a reminder does not damage anything. The app is explicit that missing a check-in does not reset a journey, and you can add one at any time. Do not rely on LAPSE as a reminder for anything that actually matters — a medication, an appointment, a deadline.
5. Subscriptions and payment
LAPSE is free to start. One journey is free to keep and to check into for as long as you like. A subscription or one-time unlock adds further journeys and lets you export your transformation as a video file.
Prices, plans and any trial are shown in the app before you buy, and are charged by Apple to your Apple Account. Auto-renewable subscriptions renew at the end of each period unless you turn off auto-renew at least 24 hours before it ends. Manage or cancel in Settings ▸ your name ▸ Subscriptions on your iPhone — not in LAPSE, because Apple owns that relationship, not us.
Refunds are handled by Apple under its own policy. We cannot issue them.
Nothing you have already made is ever taken away. If a subscription ends, your photographs remain, your journeys remain, and you keep checking into your free one. What lapses is the ability to run more than one journey and to export video files.
6. Acceptable use
Do not use LAPSE to photograph anyone without their knowledge and consent, to record anything unlawful, or in any place where photography is not permitted. Do not attempt to interfere with the app, the App Store's purchase flow, or anyone else's device.
7. Intellectual property
The LAPSE app, its name, design, icon and text are ours or our licensors', and are protected by copyright and trademark law. The licence in section 1 does not transfer any of it to you. The sample journey included in the app is illustrative content we provide and is not yours to redistribute.
8. Availability and changes
We may update, change or discontinue LAPSE or any part of it. We will not push an update that deletes your photographs. If the app is discontinued, what is on your device stays on your device.
9. Disclaimer of warranties
LAPSE is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that reminders will always arrive, or that image analysis will always judge a framing correctly.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost photographs or lost profits, arising from your use of LAPSE. Our total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim.
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
11. Termination
You may stop using LAPSE at any time by deleting it. We may terminate this licence if you breach these terms. On termination the licence ends; what is stored on your device remains yours and is unaffected.
12. Apple
These terms are between you and us, not Apple. Apple is not responsible for LAPSE or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation for the app.
